Acceptance of Terms

By using xCloudd in any capacity — including adding it to a Discord server, interacting with its commands, or accessing the web dashboard — you confirm that you have read, understood, and agree to these Terms and our Privacy Policy.

If you do not agree to these Terms, you must immediately cease using the Services and remove the Bot from any servers you manage.

Description of Services

xCloudd is a multi-purpose Discord bot offering the following features (non-exhaustive):

• Economy and virtual currency systems (coins, gambling, games)
• Moderation tools (ban, kick, warn, mute, logs)
• Server utilities (counters, welcome messages, auto-roles)
• Music playback and entertainment commands
• CAPTCHA-based role verification via a web page
• A web dashboard for server configuration and statistics

All features are provided free of charge and are subject to change at any time without prior notice.

Eligibility

• You must be at least 13 years of age to use the Services, in compliance with Discord's own Terms of Service.
• Users in the European Union must be at least 16 years of age, or have verifiable parental consent.
• By using the Services, you represent and warrant that you meet the applicable age requirements.
• Your use of Discord itself is additionally governed by Discord's Terms of Service. You are responsible for complying with them independently.

Acceptable Use

You agree not to use the Services in any way that:

• Violates Discord's Terms of Service or Community Guidelines.
• Is unlawful, abusive, threatening, defamatory, or otherwise harmful.
• Involves attempting to exploit, hack, crash, or otherwise disrupt the Bot or its infrastructure.
• Uses automated scripts, bots, or other tools to artificially interact with the Bot's commands.
• Attempts to manipulate or cheat the economy system (e.g. self-botting, exploiting bugs for coin gain).
• Involves sharing, selling, or trading Bot accounts, features, or exploits.
• Spreads false information about xCloudd or impersonates its developer or staff.

We reserve the right to determine, at our sole discretion, what constitutes a violation of these rules.

Virtual Currency & Economy

xCloudd includes a virtual economy system ("coins" or similar in-Bot currency). You acknowledge and agree that:

• All virtual currency is entirely fictional and has no real-world monetary value.
• Virtual currency cannot be exchanged, transferred outside of the Bot, sold, or redeemed for real money or goods.
• We reserve the right to reset, adjust, or remove any user's balance at any time, including in cases of suspected cheating or abuse.
• Gambling and game features within the Bot are purely for entertainment purposes. No real money is involved or implied.
• We are not liable for any loss of virtual currency due to bugs, exploits, or service interruptions.

Server Administrator Responsibilities

If you add xCloudd to a Discord server you manage, you take on additional responsibilities:

• You are responsible for ensuring that your server's members are informed about the Bot's data collection practices (as described in our Privacy Policy).
• You must use moderation features lawfully and in accordance with Discord's guidelines. You may not use the Bot's tools to harass or unjustly punish users.
• You are responsible for any configuration choices you make (e.g. auto-role assignments, logging channels, verification requirements).
• You must not use the Bot in servers that promote illegal activity, hate speech, or content that violates Discord's Community Guidelines.

Availability & Modifications

• The Services are provided on an "as-is" and "as-available" basis. We do not guarantee continuous, uninterrupted, or error-free operation.
• We may perform maintenance, updates, or changes to features at any time, with or without notice.
• We reserve the right to discontinue any feature, or the Services entirely, at any time.
• Downtime, data loss resulting from technical failures, or feature deprecation does not entitle you to any compensation.

Intellectual Property

All content, code, branding, and design associated with xCloudd — including but not limited to the Bot's name, logo, website, and source code — is the intellectual property of the developer.

• You may not copy, reproduce, redistribute, or create derivative works from any part of xCloudd without explicit written permission.
• User-generated content (e.g. messages you send via Bot commands) remains your own, but by using the Services you grant us a limited licence to process and store such content as necessary to operate the Bot.

Disclaimer of Warranties

To the fullest extent permitted by applicable law, xCloudd and its developer provide the Services without any warranty of any kind, whether express, implied, statutory, or otherwise, including but not limited to:

• Warranties of merchantability or fitness for a particular purpose.
• Warranties that the Services will be uninterrupted, secure, or error-free.
• Warranties regarding the accuracy, completeness, or reliability of any content provided by or through the Services.

You use the Services entirely at your own risk.

Limitation of Liability

To the maximum extent permitted by law, the developer of xCloudd shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of, or inability to use, the Services. This includes but is not limited to:

• Loss of data, virtual currency, or server configuration.
• Server downtime or loss of access to Bot features.
• Actions taken by server administrators using the Bot's moderation tools.
• Any harm arising from interactions between users facilitated by the Bot.

In no event shall our total liability to you exceed the amount you have paid us in the twelve months preceding the claim — which, as the Services are free, is zero.

Termination

We reserve the right to restrict or terminate your access to the Services at any time, for any reason, including but not limited to:

• Violation of these Terms or our Privacy Policy.
• Abuse of Bot features, exploitation of bugs, or cheating.
• Conduct that is harmful to other users, the Bot, or its community.
• Legal requirements or orders from authorities.

You may terminate your use of the Services at any time by removing the Bot from your server and ceasing all use of the website. Upon termination, your right to use the Services ceases immediately.

Changes to These Terms

We may update these Terms at any time. When we do, the "Last updated" date at the top of this page will be revised. For significant changes, we may post an announcement in our Discord support server.

Your continued use of the Services after any update constitutes your acceptance of the revised Terms. It is your responsibility to review these Terms periodically.
